NCSA's School Law is a one-day workshop that provides members up-to-date information on cases that impact schools here in Nebraska.

8:30 - Charting the Path to Successful Employment and Certification: 
Your Rights and Beyond
Lily Amare - Cline Williams Wright Johnson & Oldfather
The speaker will chart the path to successful employment superintendents, principals, and other administrators (collectively referred to as “administrators”). Specifically, the program will detail laws, rules and regulations applicable to administrators—precisely, their rights as certified employees of the school district. This includes the required procedures for conducting contract formation, amendment and/or cancelation.  Further, this program will detail administrator’s rights regarding actions taken regarding administrator’s certificate revocation and/or suspension.

9:30 - Special Education and Section 504 Update
Greg Perry and Haleigh Carlson - Perry Law Firm
Greg Perry and Haleigh Carlson will provide an update on special education and Section 504 issues, the civil rights law which provides protection from discrimination, student accommodations, and modifications.  This discussion will also provide a staffing update.

In this session, Jim Gessford will discuss various existing and sure to be forthcoming school technology developments and their associated policy, protocol, and legal implications to assist your school in being ready for these inevitable changes.

1:15 - Dressed to Impress: Dress Code Options and Issues

Dress code issues can come up when your board drafts a policy, but that’s often the easy part.  Enforcing a dress code can quickly become a situation that involves sex discrimination, or First Amendment issues of free speech and religious expression.  These issues arise with both student and staff attire and appearance -- and the staff issues are all too often the trickiest to navigate.  We will review what a school board and administration should consider when putting a dress code together, and walk through some cases where dress code issues have wound up in court.

In cases of student misconduct, we all know why you want to discipline a student.  We know what they did, but all too often how we discipline a student becomes a legal issue.  Whether it’s a notice letter home, picking how long a student should be suspended, or figuring out just when you can actually emergency exclude a student, administrators often slip up on some of the basic procedural steps.  KSB attorney Tim Malm will give you a “quick hit” list of the most common mistakes principals make in applying the Student Discipline Act.   We will review the finer points of the Student Discipline Act that we see missed most often, and walk through some best practices on student conduct policies.
