             Josh Schauer, Perry Law Firm
Schools across the state have faced copyright issues in recent years.  From images to music to movies, holders of copyrights are able to track down allegedly unauthorized uses of their works.  In this session, Josh Schauer will discuss the copyright issues faced by schools and offer suggestions to avoid potential liability.  The session will also address issues such as ownership of works created by students and by teachers.

Let's cut to the chase: under current law and regulations, it is virtually impossible to comply concurrently with FERPA, IDEA, state record retention statutes, public record laws, and the Secretary of State's record retention schedules applying to schools.  In this presentation, Bobby and Karen will give a brief overview of the requirements of each applicable law, including their inconsistencies, and then provide practical solutions to the record retention quagmire created by these laws, including efforts to amend state laws and regulations to make compliance easier.

10:45     The Wonderful World Of Municipal Finance

Nebraska law provides important fiscal tools that schools and education leaders must be familiar with in today’s complex world.  Among such tools are warrants, notes, lease-purchase agreements, bonds, or other evidence of indebtedness.  This session will review these tools and new related SEC rules on the difference between "Fiscal Agents, Financial Advisors, Municipal Advisors, and Underwriters.”

11:30      IEP Basics: What you think you know can hurt you!
               Karen Haase and Bobby Truhe, KSB School Law
serving the student. It is also a document with legal implications very much like a contract in which the school promises that its staff will perform certain tasks in certain ways. Karen and Bobbt review the required participants in IEP meetings, as well as the necessary components of IEPs. She’ll also examine common implementation errors made by schools and offer practical advice on how to avoid claims based on the failure of staff to implement the IEP with fidelity.

1:15       High School Activity Issues for the 2015-2016 School Year and Beyond
              Rex Shultze, Perry Law Firm
Rex will discuss the legal issues and challenges presented thereby by new initiatives and circumstances presented in high school activities in the second decade of the 21st century, including unified sports (pairing of intellectually disable students in specially designed activities), concussion prevention and education, and student participation issues.

2:15        Due Process Don't's
               Karen Haase and Bobby Truhe, KSB School Law
Lawyers have pet peeves.  For example, here's the worst legal argument in the world: "But that's how we've always done it."  A close second in terms of creating legal liability for school districts is the phrase "due process."  Karen and Bobby will discuss the main instances in the law which requires school districts to offer "due process" and the minimum requirements of those laws.  They will cover the most common areas where schools get themselves into trouble and provide specific suggestions for improving these provisions in your extracurricular handbooks, student discipline policies, and others.
