This past June, the United States Supreme Court decided Riley v. California, a case in which a police officer accessed information on the cell phone of an individual he had arrested.  Although the case does not involve schools, it has important implications for schools.  The attorneys of Harding & Shultz will review the case and provide practical suggestions for principals and other administrators who might have a reason to search student cell phones and other electronic devices.

From the saying of prayers before monthly town-council meetings to the holding of its high-school graduation ceremonies at a local Church, it seems the U.S. Supreme Court may be altering its Establishment Clause jurisprudence.  In this session, Jim Gessford will examine these two 2014 cases and their possible impact on schools along with other relevant religion and schools related legal matters.

This past legislative session, the Nebraska Unicameral once again tweaked 79-209, the state compulsory attendance law.  The attorneys of Harding & Shultz will review those changes and will provide practical advice on how schools should be complying with the new laws.  This session will also include a brief review of strategies which education research has shown to have a positive effect on student attendance.

Greg Perry will review the legal issues involved in restraints and seclusion.  This is a “hot topic,” as the use of restraints and seclusion have led to recent law suits, OCR complaints, and NDE Rule 55 complaints in Nebraska and litigation throughout the country.

Issues involving social media, including cyberbullying, continue to impact schools.  These issues often evolve too quickly for courts and legislatures to  fully address them, and school officials face increasingly difficult decisions.  In this session, Josh Schauer will discuss recent trends, laws and court decisions involving social media and the school environment.

National news headlines have been dominated over this past summer with stories of undocumented children entering the U.S. without an accompanying adult.  What are Nebraska schools to do when unaccompanied or undocumented students seek to enroll?  The attorneys of Harding & Shultz will review existing case law on immigrant students and will examine your legal obligations to homeless and migrant students.
