School Law Update - Holiday Inn - Kearney, NE - September 26, 2012

Agenda

7:45 - 9:00 am      New and First Time Nebraska Superintendents Breakfast

8:30 - 9:00 am     Registration

9:00 am - 9:45 am        Poor Policies Can Get You in Trouble
Presenters: Jim Gessford & Greg Perry, Perry, Guthery, Haase & Gessford
Board policies can be very helpful.  On the other hand, they can also create rights or procedural obstacles leading to unintended consequences.  In this session, Jim Gessford and Greg Perry will review various policy examples to watch out for.

9:45 am - 10:30 am        How Protecting Kids can Protect Educators
Presenters: Karen Haase & Steve Williams, Harding & Shultz
We have all been horrified by the revelations that Penn State football officials looked the other way while Jerry Sandusky abused children.  We all like to think that this could never happen in a Nebraska Public School.  But the line between mandatory reporting and mere unfounded suspicion or gossip is not as clear as we would like it to be.  Nebraska law requires educators to report when they have “reasonable cause to believe” that a child is being abused or neglected.  Karen Haase and Steve Williams will discuss the legal and practical issues related to protecting children.

10:30 am to 10:45 am     Break

10:45 am - 11:30 am  The Care and Feeding of Classified Employees.
Presenters: Kelley Baker & Bobby Truhe,  Harding & Shultz
Like most other aspects of education, the employment of classified staff members has become more complicated and demanding.  Kelley Baker and Bobby Truhe will review the gamut of laws regarding the employment, treatment, pay and discharge of classified employees.   They will discuss issues affecting classified employees such as hiring, employment status, contracts, policies, evaluation, and the avoidance of discrimination and unemployment compensation claims.

11:30 pm to 12:15 pm    Think Twice, Click Second & Social Media Issues
Presenter: Bobby Truhe,  Harding & Shultz
Bobby will tackle social media issues that arise in schools almost every day.  Whether it's staff email, sexting, or fake Twitter pages, social media continues to dominate the conversation.  Bobby will give you an update on the latest tech issues as they relate to all levels of your school.

12:15 pm - 1:15 pm        Lunch

1:15 pm - 2:00 pm        Statutory and Court Cases Update
Presenters: Greg Perry & Jim Gessford, Perry, Guthery, Haase & Gessford
There are always statutory and court case updates and this past year has been no different.  In this session, Jim Gessford and Greg Perry will review recent developments in statutory and case law relating to schools.

2:00 pm to 2:15 pm    Break

2:15 pm - 3:00 pm        Parents’ Rights and Schools’ Responsibilities
Presenter: Josh Schauer, Perry, Guthery, Haase & Gessford
Issues and questions regarding the rights of parents are addressed by schools every day.  From the rights of non-custodial parents to a parent challenging your curriculum, these issues are potentially complex and time consuming.  In this session, Josh Schauer will address issues regarding access to students and student records, how to handle disruptive parents, and general issues regarding parental involvement.
